Terms of Use

These terms govern the use of Chatven (the « Service »), a tool for tracking buy-and-resell operations on marketplaces, published by Maxim Lyoen-Levecq (sole trader, trading as « Chatven »). By creating an account, installing the extension or subscribing, you accept these terms. The detailed version is in the Terms of Use.

1. Service

Chatven allows you to track your purchases, items, instances and sales, analyze your margins, and observe listings on marketplaces (LeBonCoin, Vinted, eBay, Vestiaire Collective, Facebook Marketplace, etc.) via an optional browser extension. The Service is provided "as is", without any guarantee of uninterrupted availability.

2. User account

Creating an account is required to use the Service. You are responsible for the confidentiality of your password and for all activities carried out from your account. You must be 18 years of age or older.

3. Acceptable use

You undertake not to:

  • Use the Service for unlawful or fraudulent purposes.
  • Attempt to circumvent the security mechanisms, the limits of your plan or the number of authorized devices.
  • Make abusive automated use of the marketplaces, contrary to their own terms or disrupting their operation.
  • Republish or resell the data extracted by the Service.

4. Subscriptions and payment

The Service offers a free plan and paid subscriptions (Pro, Business) whose current prices are shown on the “Subscription” page. Subscriptions renew automatically and are paid by recurring debit through our provider Stripe, which alone processes your card details. You may cancel at any time, in a few clicks, from the “Subscription” page: paid access is retained until the end of the current period. By requesting immediate access to the Service, you request its performance before the end of the fourteen (14) day withdrawal period; if you subsequently withdraw, only the service actually supplied remains payable, on a pro rata basis (art. L221-25 of the French Consumer Code).

5. Data and privacy

The processing of your personal data is described in our Privacy Policy. Your business data (purchases, sales, etc.) belongs to you and can be exported or deleted at any time.

6. Third-party data

When you follow or import listings, you may record data concerning third parties (for example sellers). You are solely responsible for the lawfulness of this collection and undertake to comply with the applicable regulations.

7. Intellectual property

The code, graphic elements and the Chatven trademark are the property of the publisher. You benefit from a personal and non-transferable right to use the Service.

8. Risk related to third-party platforms

You use the extension and the Service at your own risk. Marketplaces may, at their sole discretion, limit, suspend or delete your account as well as the associated listings, ratings and sales. The publisher is in no way liable for a ban, suspension, restriction or any loss on a third-party platform resulting from the use of the Service. It is your responsibility to check and comply with the terms of use of each marketplace.

9. Limitation of liability and indemnification

The Service is provided "as is". To the extent permitted by law, the publisher is not liable for commercial decisions made on the basis of the data displayed, for consequences on third-party platforms, nor for interruptions or data losses beyond its control; its total liability is capped at the sums paid during the last 12 months. You undertake to defend and indemnify the publisher against any third-party claim resulting from your use of the Service or from the breach of these terms.

10. Termination

You may delete your account at any time from the "Account" page or by email at compte@chatven.fr. We reserve the right to suspend an account in the event of a breach of these terms, fraud or non-payment, after reasonable notice where possible.

11. Governing law and mediation

These terms are governed by French law. The consumer may have free recourse to a consumer mediator (contact details in the legal notice). In the event of a dispute, the parties will endeavor to find an amicable solution before any legal action.
